The kvanetwork.com website and associated applications (the "Platform") are comprised of various web pages, screens, applications, and features operated by KVA. The terms “we,” “our,” and “us” refer to KVA, its subsidiaries, parent companies, and affiliates, and the terms “you,” “your,” or “user” refer to any individuals or entities who access or use the Platform. The term “Seller” refers to users who sell or attempt to sell items through the Platform, and the term “Buyer” refers to users who purchase or attempt to purchase items through the Platform.

This privacy policy is intended to inform you about what kind of information we gather through the Platform and what we do with that information. By using the Platform, or continuing to use the Platform, you consent to this privacy policy in full and also to our Terms and Conditions of Use.

Revisions to this Policy

We reserve the right to change this privacy policy at any time without advance notice to you. Each time any content in our privacy policy changes, we will update the effective date on the privacy policy available through our Platform. Your use of the Platform after the effective date constitutes your consent to be subject to our then-current privacy policy. We encourage you to review our privacy policy for every new or continued use of the Platform. If you do not agree with the terms of this privacy policy, your sole remedy is to cease access to and use of the Platform

Overview of Information Collection Policy

In general, you can visit the Platform without revealing any personally identifiable information about yourself to us. We do not automatically collect any personally identifiable information about you through the Platform. We also do not collect, or require individuals to transmit, any personally identifiable financial information (as defined under Federal Regulation P (12 C.F.R. § 1016.3(q)), social security numbers (SSNs), or driver’s license numbers through the Platform.

The technical information we automatically collect does not enable us to personally identify you and is used to better understand our Platform traffic, analyze the interests of our Platform users, improve our Platform and diagnose technical errors, and for business or marketing purposes. The only personally identifiable information we collect is information you choose to provide us through voluntary forms and features of our Platform.

Cookies, Web Beacons, and Server Logs

Our Platform uses cookies and other similar technologies which are automatically generated, sent to your browser, and stored on your hard drive to record information about how and when you use our Platform. These cookies and other similar technologies identify a web browser on a specific computer or device and reveal certain non-personally identifiable information, such as browser type, language, time zone, and operating system. The cookies and other similar technologies used by our Platform do not identify the user personally, but allow the user to remain anonymous. Our Platform may still be used with cookies disabled, but some Platform functionality may be impaired.

Our Platform may also use web beacons or pixel tags and other similar technologies, which are not placed on your computer or mobile device, but instead are embedded on certain pages or screens of the Platform or in emails. When you view a page or screen or read an email with a pixel tag, web beacon, or other similar technology, a generic notice of your interaction is generated.

Non-personally identifiable information collected through our Platform may be used in aggregate for statistical purposes, and some of our analytics and digital marketing tools may combine the non-personally identifiable information collected from our Platform with non-personally identifiable information gathered from you through other websites for target advertising, remarketing, retargeting, or tracking referral purposes. Our third-party vendors, like Google and Facebook, use cookies, web beacons, and similar technologies from our Platform and generated from their systems, to: (i) serve ads to you based on past visits or usage of our Platform; (ii) to collect or receive information from our Platform and elsewhere on the internet, and use that information to provide measurement services and target ads; and (iii) show you our ads on websites and apps across the Internet. Your use of other websites and apps across the Internet is governed by the privacy policies of those websites and apps.

Our servers also log non-personally identifiable information about our Platform users and their interactions with our Platform. All non-personally identifiable information we gather using cookies, pixel tags, web beacons, server logs, or other similar technologies is used as described in this privacy policy. Opting Out of Cookies, Web Beacons, and Similar Technologies

You can manage cookie preferences and opt out of having cookies and other similar collection technologies used by adjusting the settings on your web browser or mobile operating system. If you do not want cookies stored on your computer or device, you can change the settings on your browser or mobile operating system to notify you when a cookie is about to be saved or block cookies entirely. You cannot decline web beacons; however, setting your browser or mobile operating system to decline cookies or to prompt you for a response, or installing an ad-blocker, may keep web beacons from tracking your activity.

Do Not Track Signals

Some browsers or mobile operating systems may send Do Not Track (DNT) signals to the Platform. The Platform does not currently respond to these DNT signals, and Platform users are subject to the same information tracking and use as detailed in this privacy policy.

How We Use Non-Personally Identifiable Information

The non-personally identifiable information that is collected about your visit to or usage of our Platform is used for analytics purposes to better understand our Platform traffic, analyze the interests of our Platform users, improve our Platform and diagnose technical errors, and for business or marketing purposes as determined by us in our sole discretion. This information may be aggregated and shared with or sold to third parties, but will not identify you personally. However, the non-personally identifiable information we collect may become linked to personally identifiable information if you provide personally identifiable information to us through our Platform. Any non-personally identifiable information linked to personally identifiable information is subject to our personally identifiable information sharing practices detailed in the “Personally Identifiable Information Sharing” section of this privacy policy.

Collection of Personally Identifiable Information

We do not require individuals to transmit, any personally identifiable financial information (as defined under Federal Regulation P), social security numbers (SSNs), or driver’s license numbers in connection with use of the Platform. We do not collect other personally identifiable information through our Platform unless you affirmatively and voluntarily provide this information to us through our Platform features. For example, you may provide us personally identifiable information by completing contact forms, registering for or updating an account, creating a classified or auction listing, or taking advantage of other voluntary services and features available through the Platform.

You are not required to use the Platform features that require disclosure of personally identifiable information, and you do so entirely at your own discretion. Our Platform and any analytics tools utilized by our Platform may link non-personally identifiable information with personally identifiable information you provide to us through our Platform. Any non-personally identifiable information linked to personally identifiable information is treated as personally identifiable information and is subject to our personally identifiable information sharing practices. We may also collect or receive personally identifiable information about you from third parties if you utilize certain Platform features, and such information may become linked to the information you directly provide KVA. For example, if you link your Platform account with a social media account, we may collect or receive information about you, including personally identifiable information, from such third parties.

Payment Processing

We use third party payment processors, including, but not limited to, PayPal which handle all Platform credit card payments. We do not store full credit card information on our servers, and all credit card processing for the Platform occurs through third party payment processors.

All Platform payments made via a payment processor are subject to the terms and conditions of use and privacy policy of such payment processor. You agree that any information you supply to the payment processor for a Platform payment is at your own risk, and we are not responsible for the safety, security, confidentiality, privacy or use of such information. All discrepancies in payment processor billing should be handled directly with the payment processor. You hereby release us and the Platform from all liability, damages, and claims of loss resulting from any act or omission by a payment processor or any discrepancy in payment processor billing.

Personally Identifiable Information Use and Sharing

Except as otherwise provided in this privacy policy, we will not intentionally distribute, rent or sell your personal information to third parties without your permission.

We will use your personally identifiable information to provide services requested by you, to contact you regarding our products and services, to conduct research and surveys, and to otherwise enhance your user experience. We will use your personally identifiable information to provide, improve, and promote the Platform, to analyze how users utilize the Platform, to connect Buyers and Sellers on the Platform, to communicate with you directly (including, but not limited to, through email, phone call, or text message), to personalize your user experience, provide you customer support, prevent fraud, to facilitate transactions and payments, for insurance purposes, and to respond to safety issues, disputes, legal issues, and governmental requests, among other legally permissible usage.

We may disclose your personally identifiable information if we believe it is necessary or useful to provide services to you or to inform you of other products or services available from us and our affiliates.

Your personally identifiable information may be shared with our parent companies, affiliates, subsidiaries, and third party service providers, including but not limited to: T&R Electric Supply, Inc. (“T&R Electric”), Colman Transportation, Inc. (“Colman”), Colman Logistics, Inc. (“Colman Logistics”), or Transformer Network, Inc. (“Transformer Network”).

We may connect Buyers and Sellers as part of the services we provide on the Platform. Certain information about the Buyer will be shared with the Seller, and certain information about the Seller will be shared with the Buyer; this information may include, but is not limited to, name, profile information, reviews or ratings, address, email address, telephone number, and location. We may share your personally identifiable information with our insurance partners. We may also share your personally identifiable information as necessary in order to operate the Platform properly.We also reserve the right to share your personally identifiable information in order to preserve our legal rights or to comply with applicable law, as detailed below in the “Legal Compliance” section of this privacy policy.

If we undergo any type of business transaction, including, but not limited to, an asset sale, merger, debt financing, acquisition, bankruptcy, or restructuring, your personally identifiable information or technical information we obtain from you through the Platform may be disclosed to any potential or actual purchasers and may be transferred to the new owners. Your personally identifiable information may also be disclosed to our lenders or potential lenders.

We may serve as a conduit for messages, chat, emails, and other communications between third parties and you. We may store any of the information that you provide us indefinitely, including your personally identifiable information. This specifically includes, but is in no way limited to, the information you provide about yourself or a listing. Email Addresses and Phone Numbers

We and our third party service providers use email addresses collected through the Platform to uniquely identify and communicate with users of our Platform and services. If you provide your email address to us, we may share that information with third parties, as identified in this privacy policy, to contact you at your provided email address. We may also use your email address to contact you regarding: new features, ad status, confirmation of registration, newsletters, new promotional offers, advertisements, and other Platform or service-related notices. If you provide your mobile phone number to us, we may contact you at such phone number via call or text message for business purposes. Email addresses and phone numbers may be shared as provided for in this privacy policy, as further detailed in the “Personally Identifiable Information Use and Sharing” section above.

User Profiles and User Posted Content

You may become a registered member of the Platform by creating a Platform account. If you create an account on the Platform, you may be required to provide certain personally identifiable information (including, but not limited to, your name, address, telephone number, email address, a unique login name, password and password validation, and a password hint to help you remember your password). Certain personally identifiable information that you provide in your Platform account user profile may be visible to the public. Passwords, however, are not displayed to the public or other third parties. If you do not want your personally identifiable profile information to be visible to the public, do not use the Platform. We may provide options for you to be able to control how much of the information in your profile is visible to the public, but we cannot guarantee these features will be available at all times or will be error-free. Any limitations you place on your profile information will only be for purposes of display to the public when using certain Platform features and will not limit or alter how we treat your information as described in this privacy policy.

Users may post content on the Platform, or submit inquiries to us, that may be made publicly available to other users and to the general public via the Platform. You acknowledge and agree that by posting or otherwise submitting such content on, through, or to the Platform, your personally identifiable information, including your email address and any other information you submit or supply, may be visible to the third parties. You acknowledge and agree that you will not share or submit any information on the Platform that you are not prepared to be public information, or to be available to third parties. All submissions of content, including without limitation, the posting of content to the Platform or the submissions sent to us are submitted in accordance with, and governed by, the Platform’s Terms and Conditions of Use.

If a user is posting content on the Platform for someone other than that user, in which another person or entity’s personally identifiable information will be accessible or otherwise made available, user hereby makes the material representation and warranty, upon which user wishes us to reasonably rely, that user has obtained each of those other persons’ or entities’ consent to disclose their personal information to us and other users.

Commercial Site

If you are a Platform user acting on behalf of an employer or entity, you acknowledge that you are authorized to do so and that you may be sharing certain company or corporate information with us, the Platform, and other Platform users. As further set forth in the Terms and Conditions of Use, you acknowledge that you have permission to utilize the Platform in this capacity.

Legal Compliance

We reserve the right in our sole discretion to disclose information about you without notice, including personally identifiable information, if it is necessary or appropriate to comply with applicable law, respond to legal claims and the legal process (including subpoenas), protect our rights, interests, or property, or if we believe in good faith that it is necessary to protect the rights, personal safety, or property of any person, including but not limited to: your rights, safety, or property, the rights, safety, or property of our other users or our employees, the rights, safety, or property of the public, or the rights, safety, or property of any third party.

Personally Identifiable Information Security

We use information technology security measures to protect your personally identifiable information that is transmitted through the Platform. We also use information technology security features to protect the personally identifiable information stored by us. However, in spite of our security efforts and protocols, we cannot guarantee that information sent to us through the Platform will be secure. Therefore, we make no warranties or representations regarding the security of your information, and we undertake no duty to provide Platform users notice of a security breach, unless otherwise required to do so by law.

Changing Personally Identifiable Information

It is important that we keep the most accurate, up-to-date information about you in our records. You may change the personally identifiable information we have collected about you through your account profile, or you may contact us at support@kvanetwork.com. We may require you to verify your identity before we change our records.

If you would like to deactivate your user account, you may do so through your account profile on the kvanetwork.com website. If you opt to deactivate your account, your account will be deactivated by KVA and no longer visible to the public, but we may retain information from your account and disclose it in a manner consistent with this privacy policy for unclosed accounts. We also may retain your personal information after you have deactivated your account for any business purpose we deem necessary or desirable as determined by us in our sole discretion; such business purposes may include, but are not limited to, collecting any fees owed, troubleshooting problems, resolving disputes, analyzing usage of the Platform, preventing fraud, assisting with any investigations, enforcing our Terms and Conditions of Use, or taking other actions as required or permitted by law.

Personally Identifiable Information of Children

Our Platform is not directed to anyone under the age of 18, and by using our Platform, you are confirming that you are 18 years of age or older. While this Platform does not knowingly solicit, collect, or store information of children, it is possible that through fraud, deceit, or other unauthorized or inadvertent disclosure, we may receive information pertaining to a person under the age of 18. Parents or guardians may report unauthorized use of our Platform by a child by contacting us at support@kvanetwork.com. If we are notified of unauthorized use by a person under age 18, upon verifying the information, we will immediately delete the unauthorized information from our servers and records.

International Users

The Platform is not directed to anyone located outside of the United States, and the Platform is controlled, operated, and administered by us from our offices within the United States of America. We do not knowingly offer goods or services to data subjects outside of the United States or monitor the behavior of persons (data subjects) located outside of the United States. By using or continuing to use the Platform, you are confirming that you are located within the United States, and agree that you will not provide personal information on, or otherwise use, the Platform if you are located outside of the United States. While the Platform does not knowingly solicit, collect, or store the personal information of international users, through fraud, deceit, or other unauthorized or inadvertent disclosure, we may receive personal information pertaining to individuals located outside of the United States. If a person located outside of the United States becomes aware that he or she has provided us personal information, as defined in Article 4 of the General Data Protection Regulation (GDPR), please contact us at: support@kvanetwork.com and, upon verifying the information, we will immediately delete the unauthorized information from our servers and records.

Links, Widgets, Embeds, Social Media, and Other Third Party Features

Our Platform may provide links to other websites for the convenience of our Platform users. Our Platform may also make use of widgets, embeds, social media, third-party advertisements, or other third party features that are hosted by a third party or hosted directly by us on our Platform. Your interactions with any link or third party widget, embed, social media, or other feature is governed by the privacy policy of the third party providing the widget, embed, social media, or other third party feature, or the privacy policy of the linked website. The privacy policies of third parties may be substantially different than this privacy policy, and any personally identifiable information collected by or provided to third parties will be guided by the privacy policies of such third parties. We neither own nor control third party websites, widgets, embeds, social media, or other third-party features that are accessible through the Platform. Opt-Out & Unsubscribe from Communications

We respect your privacy and give you an opportunity to opt-out of receiving certain communications from us. Users may opt-out of receiving certain email communications from KVA by clicking on the unsubscribe link in any marketing or promotional email that you receive from us. You may also email at support@kvanetwork.com to opt out of certain promotional emails. Your receipt of certain communications and alerts from KVA, including email or text messages, may also be altered through your user profile. Some features of the Platform require email communications, and, if you utilize such features, you cannot opt out of receiving email communications relating to your use of such features.
